AMIGO CAR SHARING TERMS OF USE
1. Client Requirements
1.1. the Client is legally permitted to drive a vehicle in accordance with current legislation;
1.2. has a valid driver's license;
1.3. there are no contraindications to driving a vehicle stipulated by current Moldovan legislation;
1.4. the Client is at least 21 (twenty-one) years old;
1.5. the Client has at least 2 (two) years of driving experience (category B; in Latin transliteration - B); in cases where the Client's driving experience is less than 2 (two) years, as an exception, the Client must have a Testing Certificate issued by the Artur Cecan Driving School.
1.6. meets the requirements for driving a vehicle established by current Moldovan legislation;
1.7. has permanent residence registration in the Republic of Moldova. A person may not operate a vehicle in accordance with the Agreement if they do not meet the requirements specified in this section, or if they are under the influence of alcohol, drugs, toxic substances, or any other intoxication. These requirements for the Client are not exhaustive. The Contractor reserves the right not to enter into an Agreement with a person who does not meet the requirements specified in this section, as well as if the Contractor has reason to believe that the Client (potential client) may violate the Agreement or will be unable to compensate for potential losses. The Contractor is free to enter into an Agreement, and entering into an Agreement is not an obligation.
2. Vehicle Use Period
2.1. The vehicle use period is measured in seconds. For Tariff payment purposes, the time of use is rounded up to the nearest minute. Thus, if the time of use is 1 minute and 1 second, for the purposes of the Agreement, it is rounded up to 2 minutes.
2.2. The moment the Vehicle is provided to the Client is when the Client clicks the "Book" button.
2.3. The moment the Vehicle is returned by the Client to the Contractor is the end of the Vehicle Use Session in accordance with the terms of the Agreement or the termination of use of the Vehicle for other reasons.
3. Prohibitions and Restrictions
3.1. It is prohibited to: • transfer the Vehicle for use by third parties; • use the Vehicle for training purposes; • use the Vehicle in competitions/contests (including unofficial ones), bets, contests, tests of any kind; • use the Vehicle for entrepreneurial or commercial purposes (for profit), including use as a taxi; Appendix No. 1 to the amiGO Car Sharing Agreement • use the Vehicle to transport large items, hazardous materials; • use the Vehicle for off-road driving; • use the Vehicle for towing; • use the Vehicle to transport cargo, with the exception of baggage: packages, bags, suitcases, travel bags, briefcases; • use the vehicle for transporting animals, with the exception of transporting animals in closed carriers that prevent direct contact between the animals and the vehicle; • change any characteristics of the vehicle, make improvements to/deterioration of the vehicle; • transfer control of the vehicle to third parties; • smoking, drinking alcoholic beverages, or using narcotics in the vehicle; • transporting persons under the influence of alcohol, drugs, or other intoxication; • dirtying the vehicle during the Vehicle Use Session. Leaving foreign objects in the vehicle after the end of the Use Session is also considered dirtying; • using or leaving the vehicle in violation of the Territorial Restrictions on Vehicle Use established by the Agreement; • driving into underground parking lots or areas with poor GPS or GRSP signal; • violating the technical requirements for vehicle operation established by the vehicle manufacturer; • dismantling, disconnecting, or damaging vehicle equipment; • leaving the vehicle with open doors, windows, trunk, or hood.
4. Registration and Authorization Procedure
4.1. The amiGO carsharing Mobile App is used to facilitate actions aimed at selecting, submitting a vehicle reservation request, using a vehicle, and using a vehicle under the Agreement.
4.2. The amiGO carsharing Mobile App can be used to select, submit a vehicle reservation request, use a vehicle, perform actions within a User Session, and perform other actions with a vehicle stipulated by the Agreement and technically supported by the amiGO carsharing Website and Mobile App, respectively.
4.3. Use of the amiGO carsharing Mobile App services is possible only if the Client has registered as a user in the amiGO carsharing Mobile App and has logged in to the amiGO carsharing Mobile App in accordance with the sequence of actions established by the amiGO carsharing Mobile App.
4.4. To register a Client in the amiGO carsharing Mobile Application, the Client provides the required information about himself, including his personal data: • last name, first name, patronymic; • mobile phone number, salary registered to the Client, to which an SMS with an authorization code is sent; • e-mail; • Also, the Client, when registering using the technical capabilities of the Website or the amiGO carsharing Mobile Application, sends to the Contractor scanned copies (photos) of the passport and driver's license (in full). To continue registration, the Client is obliged to tick in the appropriate field about consent to the processing of personal data, familiarization with the terms of the Agreement and acceptance of the terms of the Agreement. After specifying the data listed in this paragraph and sending a scanned copy (photo) of the documents, the Client will be notified by SMS about the need to complete the registration. After completing the registration procedure, the Client can top up the balance of the Personal Account in the amiGO carsharing Mobile Application using a bank card. The Client can also (if this mobile app feature is enabled) link their bank card (VISA or MASTERCARD) to the amiGO carsharing Mobile App. This card will be used to debit funds for services under the Agreement and which supports online payments. Linking a bank card is accomplished through interaction (redirection from the amiGO carsharing Website or Mobile App) between the Client and the Company's partner bank. If services under the Agreement are paid for using the Client's Personal Account, linking a bank card is optional. In this case, to use amiGO carsharing services, the Client must top up their Personal Account with the Contractor by transferring funds. To activate the Contractor's services and before booking or using a vehicle, the Client's Personal Account balance must be at least 200 lei. This amount includes the Deposit, as well as the amount that will be used to pay other payments in accordance with this Agreement.
4.5. The Client agrees that when linking (integrating) the Client's bank card in the amiGO carsharing Mobile App, the Contractor's partner bank will debit an amount not exceeding 300 Moldovan lei from the Client's bank card to verify the ability to debit funds from the Client's bank card.
4.6. The Contractor will verify the data provided by the Client within 1 day.
4.7. If the Client provides inaccurate or illegible information, or if the Contractor has reason to believe that the information provided by the Client is inaccurate, the Contractor reserves the right, at its sole discretion, to block the Client's access to the amiGO carsharing Mobile App service (or individual functions thereof) related to the performance of the Agreement, and to delete the Client's Account.
4.8. Upon receipt of the Client's signed Confirmation of Accession to the Agreement, the Client's Registration is completed and the Account is activated.
4.9. Upon completion of Client Registration, access to the amiGO carsharing Mobile App is granted by entering the Login and Password (Generated Password).
4.10. Authorization is granted by entering the Login and Password (Generated Password). The Provider reserves the right to establish password requirements and prohibit the use of passwords that do not meet such requirements.
4.11. After the Client has authorized the amiGO carsharing Mobile App, the Client may use the amiGO carsharing Mobile App, which provides the ability to select, request, reserve, and use a vehicle in accordance with the Agreement.
4.12. The Client undertakes to maintain the confidentiality of the Login and Password (Generated Password), as well as other personal data, including any data that may be used to access the services of the amiGO carsharing Website or Mobile App on their behalf. If the Login or Password (Generated Password) is lost, or if there is reason to believe that a third party has acquired this data (as well as other personal data), the Client is obligated to submit a request to the Contractor to block the Account using the contact information provided during Registration and select a different Password, and, subject to agreement with the Contractor, also a Login. The Account blocking request will be reviewed by the Contractor within 1 (one) hour of the request being submitted. All risks arising from the Client's failure to fulfill this obligation remain with the Client.
4.13. Upon completion of Registration, all calls to the Contractor's Information Center will be made from the registered and confirmed Contact Mobile Phone Number, or another phone number, provided that the Client provides the Client's personal data. 4.14. The Client may change the Contact Mobile Phone Number by submitting a corresponding written request to the Contractor by email at support@amigocar.md. The Contractor will notify the Client of any change to the Contact Mobile Phone Number. By sending an SMS message to the new Contact Mobile Phone Number.
4.15. The Client confirms that all actions performed using the Client Account after the Client has authorized the Client in the Mobile App using the Client Account Login and Password are the Client's actions.
5. Vehicle Use Request Procedure. Vehicle Reservation. Start and End of a Use Session.
5.1. The Client selects any available vehicle through the amiGO carsharing Mobile App, determining the vehicle's location and ensuring there are sufficient funds in their Personal Account or on their bank card to pay for the vehicle use.
5.2. The Client submits a vehicle use request using the amiGO carsharing Mobile App. After selecting a vehicle, the Client clicks the "Reservation" button, after which the vehicle use request is considered submitted.
5.3. A Vehicle Reservation Request is valid for 10 (ten) minutes from the time it is submitted. During the request period, the Client undertakes to start a Usage Session or refuse to use the Vehicle (cancellation of the Vehicle Use Request).
5.4. If the Vehicle Use Session has not been started within 10 minutes from the moment the Client's corresponding request is recorded, the booking will automatically be put on hold and converted into a paid reservation at a rate of 30 lei/hour.
5.5. The Client has the right to cancel the Vehicle Use Request, as well as terminate the Reservation, at any time before the start of Use in the amiGO carsharing Mobile Application. A use Request may be cancelled three times within 24 hours from the time the first use Request is submitted.
5.6. After canceling a second consecutive Vehicle Use Request without starting a Usage Session, only a Vehicle Reservation is permitted in accordance with the Tariffs. The possibility of submitting an application for use of the vehicle is activated 24 hours after the last cancellation of the application for use of the vehicle (for the Mobile Application - subject to repeated entry into the Mobile Application).
5.7. To unlock the doors of the vehicle and perform the actions stipulated by paragraphs 5.15-5.18 of the Rules, the Client presses the "Book" button in the Mobile Application. Within 3 (three) minutes from the moment of pressing the "Start use" button, the Client will not be charged for the purposes of performing the actions specified in paragraphs 5.15-5.18 of the Rules.
5.8. By pressing the "Book" button in the amiGO carsharing Mobile Application, the Client confirms the performance of the actions specified in paragraphs 5.15-5.18 of the Rules, and, by activating the trip, confirms the acceptance of the vehicle according to the "Acceptance Certificate" in the application. By completing confirmations in the amiGO carsharing app, the Client accepts the vehicle under the acceptance certificate and does not require the execution of any additional documents.
5.9. The Client may exit the vehicle without terminating the Usage Session. To do so, they must turn off the engine, shift the transmission to "P", roll up all door windows, exit the vehicle, close the doors, and press the "Waiting" button in the amiGO carsharing Mobile App. This places the vehicle in "Waiting" mode and charges the "Waiting" rate. In this case, the vehicle automatically locks. The vehicle can be opened using the amiGO carsharing Mobile App by pressing the "Go to Trip" button and continue the trip according to the Basic Rate.
5.10. The Usage Session is terminated by turning off the vehicle's engine, shifting the transmission to "P", and rolling up all door windows. After exiting the vehicle, the Client presses the "End" button in the amiGO carsharing Mobile App, in which case the vehicle automatically locks. The Vehicle Use Session ends when the "End" button is pressed.
5.11. Leaving the Vehicle is permitted only in compliance with the requirements established by the Agreement and the procedure established by the Rules ("Waiting" or "End" mode of the Use Session).
5.12. The term of the Vehicle Use Session begins when the "Book" button is pressed in the amiGO carsharing Mobile Application until the actual termination of the Use Session for a specific Vehicle by the Client. The actual termination of the Use Session is confirmed by pressing the "End" button in the amiGO carsharing Mobile Application. Termination of the Vehicle Use Session during vehicle towing, impound, or special parking lots is permitted only with the consent of the Contractor. 5.13. In exceptional cases, if it is impossible to use the amiGO carsharing Mobile Application, the Client has the right to perform the actions provided for in paragraphs. 5.9-5.12 By contacting the Contractor's Information Center from the Client's Contact Mobile Phone Number by calling +373 78 717 717 or by email at support@amigocar.md, to report any problems that have arisen. The Client is obliged to act in accordance with the dispatcher's instructions.
5.14. For the purpose of Client Identification, when calling the Contractor's Information Center, it may be necessary Providing personal data and a Code Word. The Contractor's Information Center Operator may offer the Client the nearest available vehicle, indicate its location, and, if the application for use or reservation of the vehicle is successful, notify the Client of the fact of the application for use or the Reservation, respectively. Actions before the start of the Use Session
5.15. Before the start of the Use Session, the Client is obliged to inspect the vehicle for defects, including: external damage, damage inside the vehicle, including: contamination of the interior, the presence (damage) of the registration and insurance documents of the vehicle (in the glove compartment of the vehicle, a standard car kit (first aid kit, fire extinguisher, emergency stop sign, safety and signal fluorescent reflective vest), all accessories and additional equipment, including mats, special equipment (clause 2.8.7 of the Agreement), registration numbers of the vehicle, and, in case of detection of damage, record the damage using photographs and report the identified deficiencies, including damage, contamination and (or) the absence of the specified documents to the Contractor through the Contractor's Information Center. Photographs recording the damage are sent via the Mobile Application, any messenger or e-mail to the Contractor's Information Center and / or to the address: support@amigocar.md. Failure to notify of external damage, damage inside the vehicle, including contamination of the interior or other deficiencies of the vehicle, the absence of or damage to registration and insurance documents on Vehicle means that the Client has accepted the Vehicle in proper condition without external damage, chips, scratches, with the presence of all the documents specified in this paragraph.
5.16. Use of the Vehicle if damage or other defects are detected, including the absence (damage) of registration or insurance documents for the Vehicle, is not permitted without the consent of the Contractor. Damage assessment is carried out by the Contractor in accordance with the Instructions for determining normal wear and tear.
5.17. If external damage or defects of the Vehicle, the absence or presence of damage to documents and items specified in paragraph 5.15 of the Rules were not detected by the Client, the Client performs the actions provided for in paragraph 5.8 of the Rules (acceptance of the Vehicle by pressing the "On Trip" button, confirmation of "Vehicle Check" and confirmation-agreement with the "Acceptance Certificate").
5.18. Upon receipt of a message about the presence of damage to the Vehicle, as well as garbage in the passenger compartment, trunk of the Vehicle, internal damage to the Vehicle, the absence of the documents specified in paragraph 5.15 Rules, other defects - and preventing the operation of the vehicle, the Client refuses to accept the vehicle (by pressing the "Cancel" button), and the Contractor can provide other vehicle options available for use in accordance with the Agreement or, in agreement with the dispatcher (operator), make the trip. Actions in the event of an accident
5.19. In the event of an accident, the Client undertakes to take all necessary actions provided for by the current legislation of the Republic of Moldova and the Agreement in relation to a participant in the accident. In addition to the specified actions, the Client undertakes to immediately notify the Contractor (Information Center) about the accident and follow the instructions of the Contractor. The first step in the event of an accident is to report it by calling +373 78 717 717 and follow the instructions of the dispatcher (operator).
6. Charging the vehicle
6.1. If it is necessary to charge the vehicle for further use, the Client shall charge the vehicle at his own expense.
6.2. The Client is obliged to leave the vehicle with a remaining battery charge of at least 25 km and inform the Contractor about the minimum charge by phone +373 78 717 717.
7. Bonuses and promotions
7.1. The Contractor reserves the right to establish various bonuses for Clients, to hold promotions expressed in the provision of preferential conditions for using the amiGO carsharing service (including booking, Service, etc.) as determined by the Contractor.
7.2. Bonuses are not issued in cash or other equivalent. Bonuses can only be used for the purpose of using amiGO carsharing services, unless otherwise provided by the relevant promotions held by the Contractor. The accounting of bonuses in points is carried out solely for the convenience of accounting for bonuses.
7.3. Bonuses expressed in the provision of additional time represent the crediting to the Client's Bonus Account of the equivalent of the cost of the corresponding number of minutes at a particular tariff in accordance with the terms of the bonus promotion. 7
.4. Bonuses are usually accrued within 24 hours following the day the Client fulfills the conditions for receiving the relevant bonus. Use Bonuses credited to the Bonus Account are only possible after they have been credited.
7.5. Unless otherwise provided by the terms of a specific bonus promotion, at the end of the User Session, the equivalent of the cost of minutes at a given tariff is debited from the Bonus Account first.
7.6. Bonuses and promotions are approved by the Contractor, and their terms are posted on the Website, in Mobile in the special appendix.
7.7. Discounts (reduction in the cost of using amiGO carsharing services) are not cumulative and can be used by the Client only on one basis - the one for which the maximum discount is provided.
7.8. The Contractor has the right to cancel Bonuses if the Contractor establishes that the Client abuses his rights to receive bonuses or to use them, including, but not limited to: distributing passwords or codes provided to him among an indefinite number of persons; transferring passwords and codes for a fee.
