amiGO Park Terms and Conditions

1. General Provisions

1.1. These Terms and Conditions constitute an agreement for the provision of digital services for finding, booking, paying for, and using parking spaces through the amiGO park mobile app. The agreement is concluded between you as the User and AMIGO PARK S.R.L. as the service provider.

1.2. Services are provided through the mobile app, web interfaces, QR tags, and integrated parking equipment, including barriers, locks, blockers, occupancy sensors, and other IoT devices, if available at a specific parking facility.

1.3. This agreement is a distance contract and an adhesion agreement. Using the app, starting a parking session, booking a space, or making a payment constitutes your acceptance of these terms and conditions in full.

1.4. The provider reserves the right to update these terms and conditions by publishing a new version on the website or in the app. Continued use of the service after the publication of a new version constitutes the user's consent to the changes.

2. Description of the amiGO park service

2.1. amiGO park allows users to find parking spaces, view zone availability, reserve a space, gain digital access to the parking infrastructure, start and end a parking session, and pay for parking at current rates.

2.2. Depending on the specific zone, the service may support hourly, daily, resident, service, subscription, or other access models. The availability of a specific rate and mode is displayed in the app.

2.3. To provide the service, the app may use user and vehicle location data, as well as parking space occupancy and geofence data.

2.4. Services may not be available throughout the Republic of Moldova. Parking availability, access rules, operating hours, and restrictions are determined in the app for each specific zone.

3. Account and Access Conditions

3.1. To use the service, the user must create an account and link a valid payment method accepted by the app.

3.2. The user is obligated to provide accurate data, maintain it up-to-date, and ensure the security of their account.

3.3. Depending on the type of parking or partner requirements, the service may request additional information, including the vehicle registration plate, vehicle make and model, vehicle photographs, identity verification, or other data necessary for parking access.

3.4. The user is responsible for all actions performed through their account, including bookings, starting parking sessions, driving through the parking infrastructure, extensions, cancellations, and terminations.

3.5. The Provider reserves the right to temporarily limit or deactivate an account if fraud is suspected, these terms and conditions are violated, unauthorized use is in arrears, or if required by law or a competent authority.

4. Use of a Parking Space

4.1. By initiating a booking or parking session through the app, the user agrees to use the parking space for a fee in accordance with the applicable rates and regulations of the relevant zone.

4.2. The user is obligated to:

comply with traffic regulations, parking rules, and the requirements of the administration of the specific area;

occupy only the space or category of space permitted for the given booking;

not block driveways, sidewalks, exits, special vehicle spaces, disabled spaces, charging stations, or other areas unless the user has special permission to do so;

Follow the app instructions, road signs, markings, and equipment directions within the parking area;

if prompted by the app, confirm the start and end of parking with a photo of the space, vehicle, or other designated method.

4.3. If a parking blocker, barrier, or other access device is used, the user is obligated to use it only for the duration of their parking session and not to interfere with the operation of the equipment.

4.4. The user does not acquire ownership or property rights to the parking space. They are granted a limited, temporary, revocable right to use the space under the terms of the current reservation or parking session.

5. Payment, Rates, and Prepayment

5.1. Parking costs are determined by the rates published in the app. Rates may be calculated per minute, hourly, daily, by subscription, or according to another rule specified in a specific zone.

5.2. amiGO park uses an in-app payment model. Payments, prepayments, debits, extensions, and other monetary transactions are processed only digitally through available payment methods.

5.3. To begin a session, the provider may require a minimum positive balance or a preliminary reservation.

5.4. A parking session begins when the start is confirmed in the app or upon entering/occupying a space, if stipulated by the rules of a specific parking zone, and ends upon the user's completion of the session or automatically according to the zone conditions.

5.5. The user is responsible for monitoring the duration of parking and promptly completing or extending the session. If the user exceeds the paid period, the provider reserves the right to charge an additional fee at the current rate.

5.6. The user agrees that any fines, additional fees, compensation for blocking a space, damage to equipment, illegally occupying a designated space, or access violations may be charged in addition to the basic parking fee.

6. Violations, Liability, and Damages

6.1. The user is responsible for damage caused to parking equipment, pavement, markings, fencing, barriers, lockers, sensors, terminals, charging stations, and other property used within the service.

6.2. If the user's actions result in damage to third parties, the service provider, or a parking partner, the user is obligated to compensate such damages in full to the extent permitted by law.

6.3. The provider is not responsible for the safety of the vehicle or property in the vehicle, unless otherwise expressly provided in a separate agreement or mandatory legal provisions.

6.4. The user is obligated to immediately report any accidents, equipment damage, a malfunctioning lock, an access dispute, an erroneous charge, a violation of markings, or any incident related to the use of the service.

7. Prohibited Actions

using someone else's account or transferring it to third parties;

interfering with the operation of the application, equipment, sensors, and access control systems;

occupying a parking space without a valid parking session or reservation, if such a reservation is required;

parking in prohibited, service, emergency, resident, or preferential zones without the appropriate authorization;

Falsify information about the vehicle, parking location, or session duration, or upload false supporting materials;

use the service for illegal purposes or to circumvent the rates and rules of a specific parking facility.

8. Suspension and Termination of the Service

8.1. The Provider reserves the right to restrict the User's access to the Service in whole or in part due to outstanding debt, abuse, security threats, partner complaints, or legal requirements.

8.2. The User has the right to terminate use of the Service at any time; however, the User is obligated to complete active parking sessions, pay accrued amounts, and settle open claims prior to termination.

9. Final Provisions

9.1. These terms and conditions are governed by the laws of the Republic of Moldova.

9.2. If any individual provision is deemed invalid, the remaining provisions shall continue to apply to the maximum extent permissible.

9.3. Electronic application logs, parking infrastructure data, payment records, geofences, session times, user digital actions, and confirmations recorded in the system can be used as evidence of service use and the volume of services rendered.
